TVA’s Section 106 Programmatic Agreement for Undertakings Subject to the National Historic Preservation Act

Notification of 30-day Public Comment Period

The Tennessee Valley Authority (TVA) proposes to implement a Programmatic Agreement (PA) as a program alternative, consistent with 36 CFR § 800.14(b), to fulfill TVA’s obligations under Section 106 of the National Historic Preservation Act of 1966, as amended, for similar and repetitive undertakings within TVA’s Power Service Area (PSA). Section 106 of the NHPA requires federal agencies to take into account the effects of their undertakings on historic properties. 

TVA is consulting with the seven State Historic Preservation Officers within TVA’s PSA, 18 federally recognized Indian tribes with an interest in the Tennessee Valley region, and the Advisory Council on Historic Preservation in the development of the PA. This notice, under 36 CFR 800.2(d), is to inform the public and interested parties of the proposed PA, and to solicit their comments. The Draft PA is available for review through January 17, 2019.
