The Tennessee Valley Authority (TVA) has evaluated a proposal by Dr. James M. Lee to grant a permanent easement to allow access to his land and issuance of a Section 26a permit to construct, use and maintain a road and aerial and underground utilities across public and his private land. Also, Dr. Lee would stabilize 3,100 feet of shoreline and develop and sell recreational vehicle (RV) camp lots.

Because federal approval would be needed to gain access to this property and proposed actions on the property need approval under Section 26a, TVA assessed the impacts of the entire development site. In this regard, cultural resources survey information indicates that there are at least two known archaeological sites on the applicant’s adjoining land. TVA has prepared this final environmental assessment (FEA) to better understand the nature and significance of the effects on the floodplain and cultural resources sites, and assess the impacts of the entire proposed Forrest Crossing Development.

As it relates to the shoreline stabilization portion of this project, TVA incorporates by reference the U.S. Army Corps of Engineers’ environmental assessment, including its analyses, findings and conclusions as well as required special conditions. The TVA land proposed to be affected is TVA Tract No. GIR-7666 or Planned Tract 262PT. The easement area would be designated Tract No. XGIR-940H.

Preliminary review and public involvement

TVA conducted a preliminary review and evaluation of the proposed project subsequent to the receipt of a detailed proposal. As a result of public participation and staff review, TVA documented its determination that, other than historic resources and floodplains, impacts to natural features such as endangered and threatened species, wetlands, and water quality were either none or minor. Therefore, the media or features receiving further attention in this FEA are floodplains and cultural resources.

TVA published a public notice on September 4, 2002 notifying the public of Dr. Lee’s proposal. TVA received four comments from representatives of the City of Parson, Town of Decaturville, County of Decatur, and the Decatur County Chamber of Commerce. Because of the potential project benefits to the local economy, all comments were in support of the project.

To meet its obligations under Section 106 of the National Historic Preservation Act, TVA, the Tennessee Historical Commission (THC) and Dr. Lee agreed that a memorandum of agreement (MOA) be developed and executed. The MOA outlines the approach to phased compliance and the effects of the undertaking on historic properties within the area of potential effect (APE). Adverse affects on historic properties will be avoided or mitigated through implementation of the executed MOA (see correspondence in Appendix D).

The draft EA was distributed to 16 other federal, state, and local agencies and tribal and conservation organizations on March 27, and posted on the TVA Web site on April 3, 2003. All issues raised by reviewers are addressed in this FEA. On April 21, 2003, the U.S. Department of the Interior, Office of Environmental Policy and Compliance, indicated that the RV park would be situated on tribal lands of the Eastern Band of the Cherokee. Based on consultation with the Eastern Band, TVA determined that the project would take place on formal tribal lands of the Chickasaw Nation. Therefore, TVA consulted with the Chickasaw during the development of this FEA and MOA. In its response dated April 24, 2001, the U.S. Fish and Wildlife Service indicated that no significant adverse impacts to wetlands or federally listed endangered or threatened species are anticipated from this proposal.

Alternatives and impacts evaluated

This FEA evaluates the impacts of two alternatives. Under the No Action Alternative, TVA would not grant an easement across Tract No. GIR-7666 or issue Section 26a approval for the road and utilities needed or approve the shoreline stabilization. Under the Action Alternative, TVA would grant a permanent easement and approve a Section 26a permit for the project, which would include construction of an access road, aerial electric lines, and underground waterlines across the easement area and onto Dr. Lee’s land to support RV camping lots. Section 26a approval is needed for the proposed fill and construction of a road, erection of aerial electric lines, and buried waterlines along approximately 3,000 feet of Tract No. GIR-7673F. Shoreline stabilization would also be approved under Section 26a.

The RV campground would be located within the limits of the 100-year floodplain and below the TVA Flood Risk Profile. For compliance with Executive Order 11988 (Floodplains Management), actions proposed are considered to be repetitive actions in the floodplain that generally result in minor floodplain impacts. The RV campground is considered to be a recreational use of the floodplain that would not result in adverse floodplain impacts provided the conditions included in this FEA are implemented.

To ensure that the project complies with the TVA Flood Control Storage Loss Guideline, the volume of road fill would also be limited. And, although the quantity of riprap would be more than 1 acre-foot, shoreline erosion at this location far exceeds the volume of riprap proposed. Therefore, there would be no loss of flood control storage. Because commitments in this FEA would also be included in the final TVA Section 26a and permanent easement agreement, as well as any future transfer document(s), the proposed project and easement would have insignificant impacts on flood control.

TVA has determined, in consultation with the THC, Dr. Lee, and other consulting parties, that the proposed development without any mitigation would adversely affect historic properties that are listed, eligible for listing, or potentially eligible for listing in the National Register of Historic Places (NRHP). Therefore, in order to mitigate the adverse effects of the undertaking, TVA, in consultation with the THC, has developed and executed an MOA which addresses identification, evaluation, phased assessment, and treatment of adverse effects on listed or eligible NRHP historic resources in Area 1 of the area of potential effect. The provisions and stipulations of the final MOA are incorporated by reference in this FEA (see Appendix C in the FEA).
